Official Contest Rules

These Contest rules are specific to the above Contest conducted by Entercom Michigan, LLC d/b/a WYCD (the “Station”).  Except to the extent specifically set forth below with respect to this specific Contest, the WYCD general Contest rules apply to this Contest as well.  A copy of these specific Contest rules and the Station’s general Contest rules are available at the Station’s website at www.wycd.com/rules.  To the extent that the WYCD general Contest rules differ from these rules, these rules will govern and control with respect to this Contest.

Who Can Enter & Be Nominated in this Contest

  1. No purchase necessary to enter or win the “Driving Heroes” Contest (the “Contest”).
  2. A “Nominee” must be both twenty-one (21) years of age or older and a legal resident of Michigan as of the nomination date. 
  3. An “Entrant” (the individual who nominates someone) must be both eighteen (18) years of age or older and a legal resident of Michigan as of the nomination date in order to submit a nomination as described below.
  4. Nominee should be a current first responder and at the time of nomination, employed as a law enforcement officer, school resource officer, emergency medical technician, paramedic, firefighter, rescuer, military serviceperson, sanitation worker, or other trained member of organizations connected with this type of work.  Notwithstanding the foregoing, Station will not be obligated to verify the employment of any nominated or winning first responder in this Contest.
  5. Entrants may NOT nominate themselves.  Nominee must be (1) individual person, and may not be a group of people, or an organization, or a company. 

How to Enter / Nominate Someone

  1. To submit a nomination for this Contest from 12:00am (ET) on May 20, 2020 through 11:59am (ET) on June 11, 2020 (the “Nomination Period”), go to www.wycd.com, click on the “Operation First Responders” Contest banner, and complete the online entry form with all of the following:
    1. Entrant’s contact information including Entrant’s full name, zip code, phone number (including area code), phone number, age, and e-mail address;
    2. The name, address, approximate age, and daytime phone number (including area code) of the person (or direct family member) you are nominating in this Contest; and 
    3. A short essay in 500 words or less describing why Nominee could use the help of a twenty-four (24) month vehicle lease (examples: always puts others first at work and at home and needs a safe car to get back and forth, etc.), and deserves a twenty-four (24)  month vehicle lease.
      1. Entrants may nominate only one person per entry (entries that nominate more than one person or a group or organization will be disqualified).
      2. If essay is over 500 words, only the first 500 words of such submitted essay will be read (i.e., longer essays will not be disqualified).
      3. Entrants are not eligible to win or receive a prize in this Contest.
      4. Essay need not be truthful. 
      5. Station will not verify the facts of any essay (only facts related to eligibility requirements (e.g., age, residence, etc…). 
      6. Entrants must nominate one other person (entries that nominate more than one person or a group or organization will be disqualified).  
    4. Click “Submit”.
  2. Failure to submit all of the above items in one submission/entry may result in immediate disqualification of such entry.
  3. By submitting an essay to a Station, each Entrant authorizes the Stations to post such essay and/or Entrant’s and Nominee’s name to the Stations’ websites, social media sites and pages, and/or to read it on air.  Stations reserve the right to edit an essay in their sole discretion.
  4. IT IS THE ENTRANT’S RESPONSIBILITY PRIOR TO ENTERING THIS CONTEST TO OBTAIN THE CONSENT OF ANY NOMINEE AND ANY OTHER PERSONS INVOLVED TO ALLOW STATIONS TO READ AND/OR POST THE ENTRANT’S ESSAY WITH RESPECT TO THE NOMINEE’S OR OTHER PERSONS’ NAMES AND PERSONAL INFORMATION WHICH IS MENTIONED IN THE ESSAY.  BY ENTERING THIS CONTEST, ENTRANTS AGREE TO INDEMNIFY AND HOLD HARMLESS STATION AND ITS AFFILIATED COMPANIES AND EMPLOYEES FROM AND AGAINST ANY CLAIM MADE BY ANY PERSONS RELATING TO THE CONTENT OF THE ESSAY SUBMITTED BY THE ENTRANT. 
  5. IT IS THE SOLE RESPONSIBILITY OF ALL ENTRANTS/NOMINATORS TO CHECK IN ADVANCE WITH THE NOMINEE TO DETERMINE WHETHER OR NOT THE NOMINEE INTENDS TO ACCEPT THE PRIZE IN THE EVENT THAT THE NOMINEE IS SELECTED AS A WINNER.
  6. WHETHER OR NOT SELECTED AS A WINNER, ALL ENTRIES BECOME THE SOLE PROPERTY OF STATION AND MAY BE USED BY STATION (OR ITS SPONSORS) IN ANY MEDIUM IT DEEMS DESIRABLE NOW OR IN THE FUTURE WITHOUT ANY COMPENSATION TO THE ENTRANT OR ANY NOMINEE.

How to Win

  1. Before 8:00am (ET) each weekday morning (Monday – Friday only) from June 1, 2020 through June 12, 2020, a panel of Station-selected judges (“Judges”) will select one (1) entry from among all entries received through 11:59am (ET) on the immediately preceding day (i.e., on June 1, 2020, Judges will select one (1) entry from among all entries received through 11:59am (ET) on May 31, 2020), based on any lawful criteria the Station deems desirable, including, without limitation, the poignancy of the essay and the need of the Nominee, and the Nominee on whose behalf each such selected entry was submitted will become a finalist, subject to verification of eligibility and compliance with these Contest rules (each, a “Finalist”).  Then, sometime between approximately 8:00am (ET) and 8:30am (ET) on the same day, the Station will announce the name of such Finalist on-air.  Neither the Entrant who submitted such selected entry nor the Finalist on whose behalf such selected entry was submitted need to be listening at the time of such announcement in order to continue in the Contest.  There will be up to, but in no event more than, ten (10) entries selected by the Station Judges as set forth in this Section 12 to continue in this Contest (each, a “Top Entry”, and collectively, the “Top Entries”).   There will be up to, but in no event more than, ten (10) Finalists in this Contest.
  2. At approximately 9:00am (ET) on June 12, 2020, Station will post the Top Entries on the station website at www.wycd.com.  Listeners will then be able to vote on their favorite Finalist until approximately 12:00pm (ET) on June 30, 2020.  LISTENER VOTES WILL NOT BE A DETERMINING FACTOR IN THE SELECTION OF QUALIFIERS BUT MAY BE, IN STATION’S SOLE DISCRETION, ONE OF MANY FACTORS TAKEN INTO CONSIDERATION IN SELECTING QUALIFIERS.
    1. Station will contact Nominees selected as potential Winners by means of the phone number that the Entrant who nominated them provided at the time of entry.
    2. Station has no obligation to notify the Entrant that their Nominee was selected as a winner; provided, however, that in the event Station is unable to successfully contact a particular Nominee selected as a potential Winner, Station may, but shall not be obligated to, contact the Entrant who selected such Nominee and request additional contact information for the Nominee.
    3. Station has the absolute and irrevocable right to notify the Nominee of the name of the Entrant(s) who nominated him/her.
  3. After 12:00pm (CT) on June 30, 2020, Station Judges will select one (1) potential winning Top Entry from among all of the Top Entries, based on any lawful criteria the Station deems desirable, including, without limitation, the poignancy of the essay and the need of the Finalist, and the one (1) Finalist on whose behalf such Top Entry was submitted will receive the one (1) prize in this Contest (as described in Section 17 below), subject to verification of eligibility and compliance with these Contest rules (the “Winner”).  Station Judges may, but are in no way obligated to, take the number of votes each Top Entry received into consideration, but voting will not be a determining factor in the selection of the Winner. 
  4. Station will announce on-air the name of the one (1) potential Winner sometime between approximately 8:00am (ET) and 8:30am (ET) on July 1, 2020.  The potential Winner need not be listening at the time of such announcement in order to win.  Station will contact the potential Winner.  Should the potential Winner not meet the eligibility requirements or become disqualified for any other reason, an alternate Winner may be selected by Station, but in the event such alternate Winner does not meet eligibility requirements or is disqualified, Station shall not be obligated to select any additional Winner in this Contest.
  5. ENTRANTS ARE NOT ENTITLED TO ANY PRIZE IN THIS CONTEST, EVEN IF THEIR ENTRY WAS SELECTED AS THE WINNING ENTRY AND/OR THEIR NOMINEE REJECTS THE PRIZE, DOES NOT COMPLETE THE REQUIRED PAPERWORK ON TIME, CANNOT BE LOCATED, OR OTHERWISE BECOMES DISQUALIFIED.

Prize(s)

  1. The one (1) verified Winner of this Contest will, subject to credit qualification and approval by Ally Financial, Inc. (“Lessor”) and compliance with all other requirements set forth in these Contest rules, receive one (1) twenty-four (24) month lease, valued at approximately $10,000.00, of the Winner’s choice of either (each, a “Vehicle”): (i) a 2020 Dodge Ram Big Horn from Szott M-59 Dodge (“M-59 Dodge”) located at 2565 E. Highland Road, Highland, MI 48356; or (ii) a 2020 Jeep Compass Limited from M-59 Chrysler Jeep (“M-59 Chrysler”, and together with M-59 Dodge, the “Dealer”) located 6700 Highland, White Lake, MI 48383 (collectively, the “Prize”).   
    1. PRIOR TO BEING RECOGNIZED AS THE WINNER OF THIS CONTEST, THE WINNER MUST PROVIDE STATION WITH ALL DOCUMENTATION REQUIRED BY STATION, AND COMPLETE A LIABILITY RELEASE AGREEMENT AND/OR AFFIDAVIT OF ELIGIBILITY, WHICH SHALL, AMONG OTHER THINGS, RELEASE THE STATION AND DEALER FROM ANY AND ALL CLAIMS, DEMANDS, OR CAUSE OF ACTION FROM PARTICIPATING IN ANY ASPECT OF THE CONTEST, SUCH WINNER’S PARTICIPATION IN THE CONTEST, AND FROM RECEIPT OF AND OR USE OF ANY PRIZES.  IN THE EVENT THAT THE POTENTIAL WINNER REFUSES TO SIGN THE REQUIRED RELEASE FORM, THEN SUCH PERSON WILL BE DISQUALIFIED AND WILL NOT WIN THE PRIZE.
    2. WINNER WILL BE REQUIRED TO MEET CERTAIN LESSOR CREDIT QUALIFICATIONS IN ORDER TO BE AWARDED THE PRIZE IN THIS CONTEST, AND IN THE EVENT THAT WINNER DOES NOT SATISFY THOSE QUALIFICATIONS AND/OR LESSOR DECLINES TO ENTER INTO A LEASE AGREEMENT WITH THE WINNER FOR ANY OTHER REASON, WINNER SHALL FORFEIT ANY CLAIM FOR ANY PRIZE IN THIS CONTEST.
    3. AT ALL TIMES DURING WINNER’S POSSESSION AND USE OF THE VEHICLE, WINNER SHALL BE SOLELY RESPONSIBLE FOR:
      1. MAINTAINING A VALID DRIVER’S LICENSE AND ACCEPTABLE FULL-COVERAGE INSURANCE;
      2. OBTAINING AND MAINTAINING STATE REQUIRED REGISTRATION AND INSPECTION, ALONG WITH ALL COSTS APPLICABLE THERETO;
      3. ALL FUEL AND MAINTENANCE EXPENSES; AND
      4. ALL OTHER FEES AND EXPENSES ASSOCIATED WITH WINNER’S USE AND POSSESSION OF THE VEHICLE, INCLUDING, WITHOUT LIMITATION, A FEE OF 25 CENTS PER MILE IN EXCESS OF 10,000 MILES PER YEAR.
    4. WINNER WILL BE REQUIRED PICK UP THE VEHICLE AT THE APPLICABLE DEALER LOCATION DURING REGULAR BUSINESS HOURS BY NOT LATER THAN JULY 20, 2020, SUBJECT TO THE EARLIER COMPLETION OF ALL OTHER REQUIREMENTS SET FORTH IN THESE RULES.
    5. WINNER MAY BE REQUIRED TO PAY APPLICABLE SALES TAX, TITLE, LICENSE AND REGISTRATION FEES (APPROX $500); PROVIDED, HOWEVER, DEALER MAY ELECT, IN ITS SOLE DISCRETION, TO EITHER PAY ALL SUCH AMOUNTS ON WINNER’S BEHALF OR TO REIMBURSE WINNER FOR SUCH AMOUNTS.
    6. FAILURE TO PICK UP THE VEHICLE, COMPLETE ALL OF THE REQUIRED FORMS AND MEET ALL OF THE REQUIREMENTS BY JULY 20, 2020 FOR ANY REASON WILL AUTOMATICALLY RESULT IN FORFEITURE OF ANY PRIZE IN THIS CONTEST BY THE WINNER AND THE PRIZE WILL NOT BE RE-AWARDED.   
    7. WINNER MUST BE LEGALLY ABLE TO SIGN ALL APPLICABLE DOCUMENTATION REQUIRED BY LESSOR AND/OR DEALER, AND EACH WINNER MUST AGREE TO BE SUBJECT TO THE TERMS AND CONDITIONS OF SUCH DOCUMENTATION, OTHER THAN THE OBLIGATION TO MAKE THE MONTHLY LEASE PAYMENT.  
    8. ANY DAMAGE TO THE VEHICLE DURING A WINNER’S POSSESSION AND USE OF SUCH VEHICLE WILL BE THE WINNER’S SOLE RESPONSIBILITY. 
       
  2. WINNER WILL RECEIVE AN IRS FORM-1099 FROM THE STATION, AND THE VALUE OF THE PRIZE WILL BE REPORTED TO THE INTERNAL REVENUE SERVICE FOR THE TAX YEAR IN WHICH THE PRIZE WAS WON.
     
  3. THERE ARE NO PRIZE SUBSTITUTIONS ALLOWED, EXCEPT IN THE SOLE DISCRETION OF STATION, WHICH MAY PROVIDE AN ALTERNATIVE PRIZE OF EQUAL OR GREATER VALUE.  NO CASH ALTERNATIVE WILL BE OFFERED.  NO TRANSFER OR ASSIGNMENT OF A PRIZE IS ALLOWED.
